Order of Agenda

Minutes:

The Convener proposed that item 1.3 (Renewal of a Taxi Drivers Licence (Suspension Hearing) be considered as the first item on the agenda.  (Article 2 of this minute refers).

 

The Committee resolved:-

to agree to the proposal.

2.

Renewal of a Taxi Drivers Licence (Suspension Hearing) - 0293

Minutes:

The Committee had before them correspondence from (a) Serco, the Council’s occupational health advisors; (b) Hamilton Medical Group; (c) NHS Grampian; and (d) the Council’s Litigation and Licensing Team relating to holder of Taxi Driver’s licence number 0293.

 

The Committee also had before them a copy of a report relating to the Taxi and Private Hire Car Driver’s medical standards for assessment of fitness to drive, which was considered and approved by the Committee on 2 June, 2010.

 

The Committee heard Paul Connolly, Solicitor, Litigation and Licensing provide background information relating to the application.

 

The Committee heard submissions on behalf of the licence holder.

 

Councillor Malone, seconded by Councillor Corral moved:-

not to suspend the Taxi Driver’s licence on the condition that the licence holder undertakes a medical every 6 months.

 

Councillor Blackman, seconded by the Convener moved as an amendment:-

to suspend the Taxi Driver’s licence on the grounds that by carrying on of the activity to which the licence relates is likely to cause a threat to public safety.

 

On a division, there voted:-  for the motion (6) – Councillors Corall, Cormie, Graham, MacGregor, Malik and Malone; for the amendment (5) – the Convener and Councillors Blackman, Reynolds, Thomson and Townson.

 

The Committee resolved:-

to adopt the motion.

3.

Renewal of a Taxi Licence - T171

Minutes:

The Committee had before them correspondence dated 19 April 2013, from Gilbert Road Medical Group relating to Taxi licence holder number T171.

 

The licence holder was not in attendance.

 

The Committee heard Paul Connolly, Solicitor, Litigation and Licensing provide background information relating to the application.

 

The Committee resolved:-

to refuse the application on the grounds that by carrying on of the activity to which the licence relates is likely to cause a threat to public safety.

4.

Renewal of a Taxi Licence - T910

Minutes:

The Committee had before them correspondence dated 19 April 2013, from Gilbert Road Medical Group relating to Taxi licence holder number T910.

 

The licence holder was not in attendance.

 

The Committee heard Paul Connolly, Solicitor, Litigation and Licensing provide background information relating to the application.

 

The Committee resolved:-

to refuse the application on the grounds that by carrying on of the activity to which the licence relates is likely to cause a threat to public safety.
