Minutes:

The Committee had before it, for its consideration, the applications listed in Appendix B to this minute.

 

The Committee resolved:-

that all applications be determined on the basis shown in Appendix B and that all licences be subject to the Council’s normal conditions unless otherwise stated.

APPENDIX A

 

 

1.         APPLICATION FOR THE RENEWAL OF A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number – 3/001

Premises - 2 Wallacebrae Road

 

The Committee had before it one letter of representation.

 

Ally Thain, Private Sector Housing Manager, advised that works on the premises had still to be completed, although this was not the reason it was before the Committee today.

 

The respondent was not in attendance.

 

The applicant was not in attendance.

 

The Committee resolved:-

(i)         to defer consideration of the application until the next meeting of the Committee to allow the applicant to attend and address the Committee on the application; and

(ii)        that officers be instructed to send copies of all future letters of representation relating to HMO applications to Police Scotland.

 

 

2.         APPLICATION FOR THE GRANT OF A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number – 3/002

Premises – 11 Weaver Terrace

 

The Committee had before it one letter of representation.

 

Ally Thain, Private Sector Housing Manager, advised that works on the premises had still to be completed, although this was not the reason it was before the Committee today.

 

The respondent was not in attendance.

 

The Committee heard from the applicant, Mr Luke Temple in support of the application.

 

The Committee resolved:-

to defer consideration of the application until the works were completed, after which time officers could grant the application under delegated powers if appropriate.

17.       APPLICATION FOR THE GRANT OF A PUBLIC ENTERTAINMENT LICENCE

Application Reference Number – 3/017

Premises – St Ninian’s Scottish Episcopal Church

 

The Committee were advised that the application had been withdrawn.

 

 

18.       APPLICATION FOR THE GRANT OF A TAXI DRIVER LICENCE – VALENTINE EKEH

Application Reference Number – 3/018

 

The Committee had before it a letter dated 24 April 2013 from Police Scotland advising that the applicant required to sit his street knowledge test prior to 27 July 2013 to prevent the application becoming a deemed grant.

 

The Committee heard from the applicant who requested that he be given an opportunity to sit the test and undertook to withdraw his application in the event that he failed to achieve a pass.

 

The Committee resolved:-

to defer consideration of the application to allow time for the applicant to make arrangements to sit the street knowledge test prior to 27 July, on the understanding that should the applicant fail to pass the test, his application would be treated as having been withdrawn.

 

 

19.       APPLICATION FOR THE GRANT OF A TAXI DRIVER LICENCE – GRANT SMITH

Application Reference Number – 3/019

 

The Committee had before it a letter dated 24 April, 2013 from Police Scotland advising (a) that the applicant required to sit his street knowledge test prior to 11 August, 2013 to prevent the application becoming a deemed grant; and (b) that the applicant had cancelled a previous appointment to sit his test and failed to attend a rescheduled appointment.

 

The applicant was not in attendance.

 

The Committee resolved:-

to refuse the application.


 

APPENDIX B

 

 

1.         APPLICATION FOR THE GRANT OF A TAXI DRIVER LICENCE

Application Reference Number – 5/001

 

The Committee had before it a letter of observation from Police Scotland dated 24 April, 2013 advising (a) that the applicant required to sit his street knowledge test prior to 7 August, 2013 to prevent the application becoming a deemed grant; and (b) that to date, the applicant had not made any arrangements to sit his test.

 

The Committee also had before it a medical assessment of the applicant from the Committee’s nominated Occupational Health Service provider (Serco).

 

The Committee resolved:-

to refuse the application.

 

 

2.         APPLICATION FOR THE GRANT OF A TAXI DRIVER LICENCE

Application Reference Number – 5/002

 

The Committee had before it a letter of observation from Police Scotland dated 30 April, 2013 and heard Sergeant Barry Skinner speak in its support.

 

The Committee heard from the applicant in support of his application.

 

Councillor Boulton, seconded by Councillor Corall moved:-

to grant the application.

 

Councillor Blackman, seconded by Councillor Kiddie moved as an amendment:-

to refuse the application on the grounds that the applicant is not a fit and proper person to hold the licence.

 

On a division, there voted:-  for the motion (9) – Councillors Boulton, Corall, Graham, Grant, Malik, Malone, Nathan Morrison, Reynolds and Townson; for the amendment (5) – the Convener and Councillors Blackman, Cormie, Kiddie and Jean Morrison CBE.

 

The Committee resolved:-

to adopt the motion to grant the application.
