Decision:
(i) to note the overview of the council’s use of investigatory powers during the calendar year 2024, as set out in this report; and
(ii) agrees that the Use of Investigatory Powers Policy remains fir for purpose.
Minutes:
With reference to article 8 of the minute of its previous meeting, the Committee had before it a report by the Executive Director of Corporate Services which (1) provided an overview of the Council’s use of investigatory powers during 2024 which focussed on the Committee’s role in respect of assurance; and (2) sought confirmation that the Use of Investigatory Powers Policy was fit for purpose.
The report recommended:-
that the Committee -
(a) note the overview of the council’s use of investigatory powers during the calendar year 2024, as set out in this report; and
(b) agrees that the Use of Investigatory Powers Policy remains fit for purpose.
In response to a question relating to whether information was published to show the businesses that had been found to be selling products illegally, Mr Forsyth, advised that the Council were prohibited from disclosing this information by the Enterprise Act 2002 unless certain very narrow exceptions applied.
The Committee resolved:-
to approve the recommendations contained in the report.
