Appointment of Chairperson

The Convener sent her apologies and in her absence Councillor Carle was nominated to Chair the meeting.

The Board agreed to consider item 2 on the agenda last (Article 6 of this minute refers).

Applications for occasional licences - Entertainment Marquee, Aberdeen Winter Village pdf icon PDF 156 KB

The Board had before it, for its consideration 3 applications for occasional licences for on sales in the Entertainment Marquee, Winter Village for the period 26 November 2015 to 03 January 2016. There were representations from Police Scotland and the LSO and an objection from NHS Grampian.

 

By way of a preliminary point Sergeant Flett stated that she would refer to the list of events provided by the applicant.

 

Sergeant Flett then spoke in support of the police representation dated 02 November 2015. Tara-Erin Gilchrist, LSO, spoke to her representation of 05 November 2015, which suggested changes to the terms of access for children and young persons and Christopher Littlejohn spoke to NHS Grampian’s letter of objection dated 04 November 2015.

 

Thereafter the Board heard from Graham Cooper, Solicitor, on behalf of the applicant. He confirmed that his client was willing to accept the recommendations outlined in the LSO report regarding access for children and young persons.

 

Councillor Cameron moved to grant the applications as amended with a condition that spirits should not  be offered for sale. Councillor Carle moved as an amendment  to grant the applications as amended with a condition that spirits will only be sold  from 17:00 hours and must be sold with a mixer.

 

On a division there voted:- for the motion (2) - Councillors Cameron and Townson; for the amendment (3) – Councillors Carle, Donnelly and Lawrence.

 

The Board resolved:-

to adopt the amendment.

Applications for occasional licences - Walk Up Bar 1, Aberdeen Winter Village pdf icon PDF 27 KB

The Board had before it, for its consideration 3 applications for occasional licences for on and off sales for Walk Up Bar 1, (South End of Union Terrace) Winter Village for the period 26 November 2015 to 03 January 2016. There was a representation from Police Scotland and an objection from NHS Grampian.

 

By way of a preliminary point, Graham Cooper, Solicitor, informed the Board that his client was no longer seeking to 02:00 hours on 01 January for this application.

 

Sergeant Flett spoke in support of the representation from Police Scotland dated 05 November 2015 and Chrsitopher Littlejohn spoke to the objection from NHS Grampian dated 04 November 2015.

 

Thereafter Graham Cooper, Solicitor, spoke in support of the application. He confirmed that no spirits would be sold from Walk Up Bar 1.

 

The Board resolved:-

to grant the applications in respect of off sales only from 10:00 to 22:00 hours daily.

The Board had before it, for its consideration 3 applications for occasional licences for on and off sales for Walk Up Bar 2, Union Terrace, Winter Village for the period 26 November 2015 to 03 January 2016. There were objections from Police Scotland and NHS Grampian.

 

By way of a preliminary point Graham Cooper, Solicitor, confirmed that having taken account of the police observations the location of the bar had been moved to the Union Terrace slip road. He also confirmed that his client was no longer seeking to 02:00 hours on 01 January 2016.

 

In light of this information, Sergeant Flett stated that the objection to the application from Police Scotland was being withdrawn but the representation regarding the type of alcohol for sale remained.

 

The Board resolved:-

to grant the applications.

The Board was advised that the applications were being withdrawn.
