Minutes: The Board had before it a letter of representation dated 18 May 2016 from Police Scotland and a letter of objection dated 20 May 2016 from NHS Grampian.
Mrs O’Hare, Legal advisor, advised the Board that a late letter of objection had been received from Torry Community Council. A representative from the Community Council was not presented at the meeting but an email had been received to advise that due to the personal circumstances of the Secretary of the Community Council the letter had been submitted late.
The Board resolved:
to consider the letter of objection from Torry Community Council.
The Board had before it a letter of objection dated 24 May from Torry Community Council.
The Board heard from Ms Wilson speak to the letter of objection from NHS Grampian and thereafter heard from Sergeant Flett speak to the Police letter of representation.
Thereafter, Mr Gibson, addressed the Board on behalf of the applicant in support of the application.
Councillor Donnelly moved to grant the application.
Councillor Boulton moved as an amendment to refuse the application on the grounds that it would be inconsistent with the licensing objective of protecting and improving public health.
On a division there voted for the motion (3): - Councillors Copland, Donnelly and Townson; for the amendment (4): - The Convener and Councillors Carle, Lawrence and Yuill.

The Board heard from Ms Wilson speak to the letter from NHS Grampian, Sergeant Gill Fleet speak to the Police letter, Tara-Erin Gilchrist speak to the LSO memo and Andrew Gilchrist speak to the Environmental Health memo.
Thereafter, Mrs Hood, Solicitor, addressed the Board in support of the application.
Mrs Hood confirmed that that the applicant accepted the recommendation that the use external area cease at 22:00. Mrs Hood also confirmed that they accepted the LSO recommendations in respect of the terms on which children and young persons were permitted access to the premises. Mrs Hood further confirmed that the applicant would amend the commencement of the core hours on a Friday and Saturday to bring the hours within 14 hours of continuous trading as per the Board policy. Finally the applicant voluntarily offered to impose the Board’s local condition in respect of Door Supervisors.
The Board resolved: - To grant the application as amended and with the following conditions:
(1) The Board’s local condition in respect of Door Supervisors and (2) That significant entertainment in the form of live music, live performances, theatre or cabaret must be available throughout the hours of 01:00 and 03:00

Minutes: By way of a preliminary point the Board were advised that the applicant had submitted an amended operating plan.
In the circumstances the LSO withdrew her memo.
The Board had before them a letter of representation from Police Scotland dated 10 June 2016 and a representation from Environmental Health dated 01 June 2016,
The Board heard from Sergeant Gill Fleet speak to the letter from Police Scotland.
Thereafter, Ms Junner, Solicitor, addressed the Board in support of the application. Ms Junner confirmed that baby changing facilities would be installed. She confirm that they had removed the term “generally” from the children and young persons access and had amended the times that children and young persons would be permitted in the premises to 22:30.
Following some discussion Ms Junner offered to further amend the operating plan so that Children would be permitted access to the premises until 20:00 hours and Young Persons until 22:30.
