The Board had before it for its consideration the minutes of meeting of 30 November 2023.

The Board resolved:

The Board heard from Sandy Munro, Depute Clerk to the Board that there had been no objections or representations received and everything was within policy.

The Board thereafter heard from Janet Hood, Solicitor for the applicant, in support of the application.

The Board heard from Sandy Munro, Depute Clerk to the Board that there are objections from Police Scotland and a member of the Public. The Board further heard from Sandy Munro, that the applicant sought to vary on consumption terminal hour on Monday, Tuesday, Wednesday, Thursday and Sunday to 03:00 which is outwith the policy.

The Board thereafter heard from Archie MaCiver, on behalf of applicant, in support of the application.

The Board heard from Police Scotland that they are objecting to the application on the grounds that the terminal hour sought from Sunday to Thursday falls out with Board Policy for Aberdeen city centre licensed premises.

The public objector was absent.

The Board thereafter heard from applicant, Richard Bleakley, speak in support of the application.

The Board heard from Sandy Munro, Depute Clerk to the Board, that the LSO had advised that the premises licence holder appears to have gone into administration and the premises has been closed for a period of time.

The Board thereafter heard from Cllr Boulton that there is a new business group looking to occupy the premises that may be interested in having the premises licence transferred.

The Board unanimously resolved:

To defer the review of the premises licence to the next Board meeting.

The Board heard from Sandy Munro, Depute Clerk to the Board, that the premises licence holder contacted licensing on 17 January 2024 and advised that arrangements will be made to pay the outstanding annual fee. The Board further heard from Sandy Munro, that the payment had not been received as of 24 January 2024. 

The Board unanimously resolved:

To defer the review of the premises licence to the next Board meeting. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that the premises licence holder’s company had been liquidated since 2022 and there had been no transfer application received in respect of the licence.

The Board unanimously resolved:

To revoke licence. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that the premises licence holder contacted licensing on 17 January 2024 and advised that arrangements will be made to pay the outstanding annual fee. The Board further heard from Sandy Munro, that the payment had not been received as of 24 January 2024. 

The Board unanimously resolved:

To defer the review of the premises licence to the next Board meeting. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that the LSO noticed that the premises had been closed for a period of time and that the premises licence holder had advised that it was their intention to surrender the premises licence.

The Board unanimously resolved:

To revoke licence. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that the premises licence holder had paid the outstanding annual fee and that no further action is required.

The Board heard from Janet Hood, Solicitor for the premises licence holder, that her client is currently away overseas and requested that the Board defer the review of the premises licence to allow her client arrange payment of the outstanding annual fee due.

To defer the review of the premises licence to the next Board meeting. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that the LSO had visited the premises on several occasions and on each visit the premises was closed. The Board further heard from Sandy Munro, that the LSO had exhausted all avenue to contact the premises licence holder but was unsuccessful.

To revoke licence. 

The Board heard from Sandy Munro, Depute Clerk to the Board, that business activities are currently undertaken at the premises and that the licence holder had advised the LSO that alcohol will no longer be sold.

The Board heard from Sandy Munro, Depute Clerk to the Board, that the premises is currently closed and that it is indicated on Companies House Register that licence holder’s company is on liquidation.

The Board heard from Elaine Mottram, Chair, Local Licensing Forum that there are no update for the Licensing Forum.

The Board heard from John Philip, Licensing Standards Officer, that there are no update and that Licensing Standards team will continue to contact premises licence holders to pay their outstanding premises annual fees.
