Determination of Urgent Business

Minutes:

In terms of Standing Order 28(5)(vi), and in accordance with Section 50(B)(4)(b) of the Local Government (Scotland) Act 1973, the Sub Committee was informed that it had to determine: (1) that the items on the agenda were of an urgent nature; and (2) that the Committee required to consider the items and take decisions thereon.

 

The Sub Committee resolved:

to agree that the items were of an urgent nature and required to be considered this day.

The Sub Committee had before it 6 requests for film classification for screening at Belmont Cinema as follows:-

(1)       French Film Festival School Screenings

(c)        Marie’s Story - Suggested rating (12A)

(d)       Not My Type – Suggested rating (15)

(e)       In The Courtyard – Suggested rating (15)

(f)        Paris Follies – Suggested rating (15)

(g)       Get Well Soon – Suggested rating (12A)

(h)       9 Months Stretch – Suggested rating (15)

 

The Sub Committee resolved:

to approve the film classification certificates as listed above.

3.

Renewal of a Taxi Driver's Licence

Minutes:

Application Reference Number – 7/06

 

With reference to article 6 of appendix B of the minute of the Licensing Committee of 2 September 2014, the Sub Committee had before it letters from the Committee’s nominated Occupational Health Service Provide (Serco) dated 29 July and 8 October 2014 in relation to the applicant.

 

With the applicant’s permission, Legal Services circulated a letter from the applicant’s doctor dated 28 May 2014 which had been sent to Serco for consideration following the Licensing Committee’s meeting of 2 September 2014.

 

The Sub Committee heard the applicant speak in support of the application.

 

The Sub Committee resolved:

to refuse the application on the grounds of public safety.

4.

Renewal of a Taxi Driver's License

Minutes:

With reference to article 7 of appendix B of the minute of the Licensing Committee of 2 September 2014, the Sub Committee had before it (1) letters from the Committee’s nominated Occupational Health Service Provide (Serco) dated 18 June and 8 October 2014 in relation to the applicant; and (2) a letter from the applicant dated 15July 2014.

 

With the applicant’s permission, Legal Services circulated letters from the applicant’s medical professionals which had been sent to Serco for consideration following the Licensing Committee’s meeting of 2 September 2014.

 

The Sub Committee heard the applicant speak in support of the application.

 

Councillor Townson, seconded by the Convener moved:-

that the application be refused on the grounds of public safety.

 

Councillor Cormie, seconded by Councillor Malone moved as an amendment:-

that the application be granted for a period of six months. 

 

On a division, there voted:- for the motion (2) – the Convener and Councillor Townson; for the amendment (2) – Councillors Cormie and Malone.

 

There being an equality of votes, the Convener exercised his casting vote in favour of the motion.

 

The Sub Committee resolved:

to adopt the motion.
