Minutes:

The Committee had before it, for its consideration, the applications listed in Appendix B to this minute.

 

The Committee resolved:-

that all applications be determined on the basis shown in Appendix B and that all licences be subject to the Council’s normal conditions unless otherwise stated.

APPENDIX A

 

 

1.         APPLICATION FOR THE RENEWAL OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number – 2/001

Premises – 147 Bannermill Place

 

The Committee had before it a letter of representation.

 

Mr Ally Thain, Private Sector Housing Manager, advised that upgrading works on the premises had been completed, however the safety work instructed by the Scottish Fire and Rescue Service had not been completed, although this was not the reason it was before the Committee today.

 

The Committee heard from the respondent.

 

The Committee then heard from the applicant, Ursula George, in support of the application.

 

Councillor Townson, seconded by Councillor Kiddie moved:-

that the application be granted.

 

Councillor Delaney, seconded by Councillor Corall moved as an amendment:-

that the application be granted for a period of 12 months, during which time the premises be monitored in terms of any anti social behaviour incidences.

 

On a division, there voted:- for the motion (8) – the Convener and Councillors Cormie, Graham, Kiddie, MacGregor, Malik, Townson and Young; for the amendment (2) – Councillors Corall and Delaney.

 

The Committee resolved:-

to adopt the motion to grant the application under delegated powers, subject to the Scottish Fire and Rescue Service being satisfied with fire safety issues within the property.

Application Reference Number – 2/008

Premises – Cairncry Community Centre

 

The Committee were advised that the application had been withdrawn.

 

 

9.         APPLICATION FOR THE RENEWAL OF A MARKET OPERATORS LICENCE – INTERNATIONAL MARKET, GERAUD MARKETS (UK) LTD

Application Reference Number – 2/009

Location – Union Terrace from its junctions with Union Street and Schoolhill, including Diamond Lane

Days/Times – Four Markets Per Year – Spring, Summer, Autumn and Winter

 

The Committee had before it a letter from the Housing and Environment Service recommending that suitable facilities would need to be made available to enable effective hand washing to be undertaken by food handlers.

 

The Committee heard from the applicant’s agent Mr John Connolly in support of the application.  He assured the Committee that appropriate facilities would be made available to maintain adequate personal hygiene.

 

The Committee resolved:-

to grant the application. 

 

 

10.       APPLICATION FOR THE GRANT OF A SECOND HAND DEALER’S LICENCE – MOREEN MITCHELL (BUCHAN)

Application Reference Number – 2/010

Location – Castlegate

Dates/Times – Friday and Saturday, 07.00 to 16.00

 

The Committee were advised that the certificate stating that the applicant had displayed the notice at or near the premises for a period of 21 days beginning with the date on which the application was submitted to the local authority had been undertaken.

 

The applicant was in attendance.

 

The Committee were reminded of the Council’s policy that no street trading in Union Street or any pedestrianised area of the city centre is permitted unless a special case can be made by the applicant.  It was also noted that there was no markets currently on the Castlegate.

 


 

The Committee resolved:-

to grant the application.

 

 

11.       APPLICATION FOR THE GRANT OF A STREET TRADER LICENCE – COVE BAY NURSERIES

Application Reference Number – 2/011

Location – The Green, Bottom of stairs leading to Union Street

Dates/Times – Fridays, 07.00 to 15.00

 

The Committee had before it correspondence from Doug Ritchie, Team Leader, Traffic Management and Road Safety who requested that the applicant comply with the following three conditions:-

1.    The applicant must not occupy or store goods on the footpath area and maintain it to its full width at all times;

2.    The area at the bottom of the steps has just recently had new drop kerbs installed along with tactile paving to assist members of the public to cross this section of the road.  These new drop kerbs must be kept clear at all times;

3.    This area of “The Green” has restricted access and egress times for vehicles entering the area.  The trader must ensure that the vehicle complies with those times otherwise they will be open to enforcement by Police Scotland.  This relates to the movement in and out of “The Green” area and not to the vehicle being parked out with these times.

 

The applicant, Aileen Penny was in attendance and agreed to adhere to the above conditions.

The applicant Ian David Penny was in attendance.

The Committee were advised that the application had been withdrawn.

The Committee were advised that to date the applicant had not passed the street knowledge test.

The Committee had before it a letter of representation from the Chief Constable, Police Scotland, Aberdeen City Division dated 5 February 2014 and heard Sergeant Gillian Flett speak in its support.

 

The Committee heard the applicant speak in support of her application.

2.         APPLICATION FOR THE RENEWAL OF A TAXI DRIVER’S LICENCE

Application Reference Number – 5/002

 

The Committee had before it correspondence dated  31 January 2014, 8 and 11 October 2013 from Lynn May and Paul Connolly, Solicitors, Litigation and Licensing relating to a meeting of the Evidential Hearings Sub-Committee held on 10 October 2013.

 

The Committee also had before it correspondence from the Chief Constable, Police Scotland, Aberdeen City Division, dated 3 October, 2013 and heard Sergeant Gillian Flett speak in its support.

 

The Committee heard from the applicant in support of the application.

 

The Committee resolved:-

to defer consideration of the application to allow the applicant time to obtain a vehicle for testing at Fleet Services, following which, if the vehicle passes the test, that the application be considered by the Informal Business panel prior to 8 June 2014 (the date by which that the application must be determined).
