Minutes:

The Committee had before it, for its consideration, the applications listed in Appendix B to this minute.

 

The Committee resolved:-

that all applications be determined on the basis shown in Appendix B and that all licences be subject to the Council’s normal conditions unless otherwise stated.

APPENDIX A

 

 

1.         APPLICATION FOR THE GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number – 3/001

Premises - 10C Powis Circle

 

The Committee had before it a letter of representation.

 

Mr Ally Thain, Private Sector Housing Manager, advised that upgrading works on the premises had still to be completed, although this was not the reason it was before the Committee today.

 

The Committee heard from the respondent.

 

The Committee heard from the applicant in support of the application.

 

The Committee resolved:-

to defer consideration of the application until the works were completed, after which time officers could grant the application under delegated powers if appropriate.

 

 

2.         APPLICATION FOR THE RENEWAL OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

The Committee were advised that the application had been granted under delegated powers.

 

 

3.         APPLICATION FOR THE GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

4.         APPLICATION FOR THE GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

With reference to Appendix A (item 1) of the minute of the previous meeting of 13 May 2014, Mr Ally Thain, Private Sector Housing Manager, advised that the application was due to be considered for the reason that it had been submitted within one year of the date of refusal of the previous HMO licence application.

           

He explained that the local authority may consider a further application for an HMO licence where it is satisfied that there had been a material change of circumstances.

 

The Committee heard from the applicant’s agent Ms Jenny Leys, in support of the application. She indicated that the works undertaken to the property constituted a material change of circumstances.

 

The Committee resolved:-

to refuse the application on the basis that the Committee were not satisfied that the reason given constitutes a material change of circumstances.

 

 

5.         APPLICATION FOR THE GRANT OF A MARKET OPERATOR LICENCE – ABERDEEN CASTLEGATE MARKET

Application Reference Number – 3/005

Location - Aberdeen Castlegate Market

Dates/Times – Friday, Saturday, Sunday and Public Holidays

09:00 to 17:00

 

The Committee had before it correspondence dated 11 March, 2014 from Andy Gilchrist, Housing and Environment which advised that the service had no objection to the licence being granted on the following condition:-

that suitable facilities are available to enable effective hand washing to be undertaken by food handlers by food handlers’.

 

The Committee also had before it correspondence dated 11 June, 2014 from Tom Moore, City Centre Manager, Enterprise Planning and Infrastructure which explained that before traders could operate on or occupy public footways or roadways, they require permission from the Director of Enterprise, Planning and Infrastructure Service, and to supply full details of the operation of the stalls, site map, parking arrangement for vehicles, management and setting up conditions.

 

The Committee heard from the applicants in support of their application. The applicants assured the Committee that appropriate facilities would be made available to maintain adequate personal hygiene.

 

The Committee resolved:-

to grant the application for a period of 18 months subject to the applicant complying with Enterprise, Planning and Infrastructure conditions.

 

 

6          APPLICATION FOR THE GRANT OF A SECOND HAND DEALER LICENCE - LESLEY MARGARET GRAHAM

Application Reference Number – 3/006

Location – Aberdeen Antique Centre, 24 South College Street

 

The Committee were advised that the application required to be considered by 2 September, 2014 and that the applicant had not provided a certificate stating that they have complied with the requirement contained in paragraph 2 of Schedule 1 to the Civic Government (Scotland) Act 1982 to display a notice at or near the premises for a period of 21 days beginning with the date on which the application was submitted to the licensing authority.

 

The applicant was not in attendance.

 

The Committee resolved:-

to defer consideration of the application until the next meeting of the Committee.

 

 

7.         APPLICATION FOR THE RENEWAL OF A STREET TRADER LICENCE - PRAWIT PHANUTHAT

9.         APPLICATION FOR THE RENEWAL OF A TAXI LICENCE- TONY ADU

Application Reference Number – 3/009

 

The Committee were advised that the application required to be determined by 28 July, 2014 and that Fleet Services had advised that to date the vehicle had not passed inspection and/or had not been presented for inspection.

The Committee heard from the applicant Tony Adu in support of his application.

 

The Committee resolved:-

to refer the application to the Licensing (Urgent Business) Sub-Committee for  consideration.

The Committee had before it a letter of representation dated 8 May, 2014 from the Chief Constable, Police Scotland, Aberdeen City Division and heard Sergeant Barry Skinner speak in its support.

3.         APPLICATION FOR THE GRANT OF A TAXI DRIVER'S LICENCE

The Committee had before it a letter of objection dated 10 April, 2014 from the Chief Constable, Police Scotland, Aberdeen City Division and heard Sergeant Barry Skinner speak in its support.

 

The Committee heard from Mr Gary Sturrock, the applicant’s agent in support of the application and who had also requested that three letters of support be circulated to members for consideration. Sergeant Skinner had no objection to their circulation. The Committee agreed to circulate the letters of support.
