The Committee had before it, for its consideration, the applications listed in Appendix B to this minute.

 

The Committee resolved:-

that all applications be determined on the basis shown in Appendix B and that all licences are subject to the Council’s standard conditions unless otherwise stated.

APPENDIX A

 

 

1.            GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number - 4/01

Premises - 7 Roslin Terrace, Aberdeen

 

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and two letters of representation.

 

Mr Thain advised that a further letter of representation had been received in respect of the application beyond the statutory time period within which such letters must be received (21-day period).  He further advised that the Committee might consider late representation if it was satisfied that it was reasonable for the respondents to make the representation after the deadline.

 

The respondent, Mrs Donaldson was present and explained why the letter of representation was late and why it should be considered today.

 

The Committee resolved:-

that the letter of representation by Mr and Mrs Donaldson be introduced into the proceedings.

 

The Committee heard from all three of the respondents, namely:  Mr Green, Mr Coutts on behalf of Mr Jones and thereafter Mrs Donaldson.

 

The Committee then heard from the applicants Mr and Mrs Anderson in support of the application.

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and five letters of representation.

 

The Committee heard from Ms McIntosh on behalf of Mr Hughes and Mr Bennett.  The remaining three respondents were not present, nor represented.

 

The Committee then heard from the applicant Ms Douglas in support of the application.

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and thirteen letters of representation.

 

Mr Thain advised that a letter from the applicant’s agent had been received and the applicant, Mr Piyal confirmed that he wished for the letter to be circulated and advised that it was in response to the letters of representation. 

 

The Committee resolved:-

that the letter from Mr Hossan, the applicant’s agent, be introduced into the proceedings.

The Committee heard from Ms Whitbey, one of the respondents, who advised that she was also speaking on behalf of the other respondents, Mr and Mrs Cook, who could not be present at the meeting.

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and one letter of representation.

 

Mr Thain advised that a letter from the applicant’s representatives, Laurie and Company, had been received and the applicant’s representative confirmed that he wished for the letter to be circulated and advised that it was in response to the letter of representation.  The respondent advised that he had no objection to the letter being introduced into proceedings.

Application Reference Number - 4/10

Premises - 130 Hamilton Place, Aberdeen

 

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager which advised that the applicant had requested an HMO for an occupancy of ten tenants, however although all required works had been completed in the main house which could accommodate nine tenants, the basement and annexe remained uninhabitable with an enforcement notice having been placed on both areas by Building Standards.  In addition, it was advised that the Prohibition Notice issued by the Fire and Rescue Service was still in place in respect of the basement.  On this basis, it was advised that the maximum occupancy could only be nine tenants.

 

The applicant, Mr Mearns, was in attendance and spoke in support of the application.

 

The Committee resolved:

to grant an HMO licence with a maximum occupancy of nine persons.

 

 

11.         GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

13.         APPLICATION FOR A TEMPORARY PUBLIC ENTERTAINMENT LICENCE - LONDON OCKTOBERFEST LTD

Location –

 

The Committee had before it (1) an information note which advised that this item had been placed on the agenda (a) as Police Scotland had recommended that if the temporary public entertainment licence were to be granted, three additional conditions should be attached to the licence and (b) as Building Standards would not be in a position to provide a report on the premises until the applicant was on site and therefore it was recommended that the Committee consider, if minded to grant the application, whether to give officers delegated powers to grant the application following the report from Building Standards; and (2) a letter from Police Scotland which requested that in terms of Paragraph 3(1) of Schedule 1 of the Civic Government (Scotland) Act 1982, that the following conditions be added to the temporary public entertainment licence:

1.     A senior steward should be appointed to be available on the premises at all times to liaise with Police, Licensing Standards Officers, or other local authority officials.  A contact telephone number for that person must be available prior to the event;

2.     The capacity of the premises, as determined prior to the event, was not to be exceeded and was to be monitored and recorded effectively at all times; and

3.     In order to allow the Police Service of Scotland to adequately police the event and secure public order and safety, the applicant must, no later than 7 days prior to the event, sign an agreement for the provision of Police services and pay in advance and in full, costs to the Police Service of Scotland, Aberdeen City Division, for the deployment of one Police Sergeant and five Police Constables for the hours required over the five days of the event.

 

The Committee was advised that the applicant had confirmed that they had no objection with the proposed conditions.

 

The Committee resolved:

to agree that the three additional conditions proposed by Police Scotland be attached to the Licence and that the Team Leader for Licensing grant the application under delegated powers should Building Standards have no objection once it was in a position to inspect the site, otherwise to refer the application to the Licensing Urgent Business Sub Committee.

 

 

14.         RENEWAL OF A LATE HOURS CATERING LICENCE - YASSINE MBARKI

Application Reference Number - 4/14

Location – Kordoba, 311 George Street

 

The Committee had before it an information note which advised that this item had been placed on the agenda because it required to be determined by 20 October 2015 and that to date the applicant had not provided a certificate stating that they had complied with the requirement contained in paragraph 2 of Schedule 1 to the Civic Government (Scotland) Act 1982 to display a notice at or near the premises for a period of 21 days beginning with the date on which the application was submitted to the licensing authority. 

 

The applicant, Yassine Mbarki, was in attendance.

 

The Committee resolved:

to defer consideration of the application to enable the applicant comply with the requirement to contained in paragraph 2 of Schedule 1 to the Civic Government (Scotland) Act 1982 to display a notice at or near the premises for a period of 21 days and thereafter to agree that the Team Leader for Licensing approve the application under delegated powers if appropriate or, otherwise to refer the application to the Licensing Urgent Business Sub Committee should the requirements of the Act not be complied with.

41.         SUBSTITUTION OF A TAXI LICENCE - THOMAS GEORGE

Application Reference Number - 4/41

 

The Committee was advised by Mrs May, Legal Advisor, that this item was on the agenda, as the Committee had a policy that any substitution vehicle could not be more than 5 years old and the substitution vehicle in this application did not meet that requirement.

 

Mrs May further advised that Mr Campbell, Unite, had advised that the applicant, nor himself, were able to attend the meeting, however wished to highlight that the Committee had approved applications where the vehicle did not meet this requirement in the past.  Mrs May confirmed that two substitution vehicles which did not meet the 5 year age requirement had been granted by the Committee previously.

 

The Committee also had before it a letter from the applicant, which included photos of the vehicle.

 

The applicant was not in attendance.

 

The Committee resolved:

to grant the application, subject to the vehicle passing the required vehicle inspection.

 

42.         RENEWAL OF A PRIVATE HIRE CAR LICENCE - AB TRANSFER LTD

Application Reference Number - 4/42

 

The Committee had before it an information note which advised that this item was on the agenda as the licence was due for renewal and reports had been received that between 8 June and 24 June 2015 the vehicle with licence PH306 was displaying an Aberdeen City private hire car plate in its rear window and an Aberdeenshire private hire car plate was affixed to the rear of the vehicle.  This matter, for which photographic evidence was provided, could be seen as a breach of Private Hire Care licence conditions 10 and 15.

 

The note further advised that Private Hire Car licence PH306 was suspended by the authorised officer in terms of section 11 of the Civic Government (Scotland) Act 1982, as the licence holder had failed to present the vehicle for re-testing following its failure to meet the required standards at its last statutory vehicle test.  To date, the vehicle had not been presented for re-testing and this would also prohibit the renewal of the licence.

 

The applicant, Evita Judina, was in attendance and spoke in support of the application during which she clarified the position with regards to the displaying of the licence plates and the outstanding required testing of the vehicle.

 

Mr McKane, Enforcement Officer, advised of the legal position in relation to a vehicle displaying and/or holding two licences in two different authorities.

 

The Committee resolved:

to defer consideration of the application to enable the further inspection on the applicant’s vehicle to be undertaken and to grant delegated powers to the Team Leader for Licensing to approve the application should the vehicle pass the required vehicle inspection and the vehicle’s licence for Aberdeenshire surrendered, or, otherwise to refer the application to the Licensing Urgent Business Sub Committee should the vehicle not pass the inspection and/or the vehicle’s Aberdeenshire licence not be surrendered.

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and a letter of representation from the Chief Constable, Police Scotland, c/o Aberdeen City Division and heard Sergeant Gillian Flett speak in its support.

 

The applicant, his representative and architect were in attendance.

 

The applicant’s representative spoke in support of the application during which he advised that he wished to circulate a document to the Committee.  The Convener asked the applicant’s representative to advise of the relevance of the document.
