The Committee had before it, for its consideration, the applications listed in Appendix B to this minute.

 

The Committee resolved:-

that all applications be determined on the basis shown in Appendix B and that all licences are subject to the Council’s standard conditions unless otherwise stated.

1.            GRANT OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

Application Reference Number - 4/01

Premises - 32 Rosebery Street, Aberdeen

 

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and fourteen letters of representation.

 

Mr Thain advised that two further letters of representation had been received in respect of the application beyond the statutory time period within which such letters must be received (21-day period).  He further advised that the Committee might consider late representations if it was satisfied that it was reasonable for the respondents to make the representation after the deadline.

 

One of the late respondents, Dr and Mrs King were present and explained why their letter of representation was late and why it should be considered today. The applicant’s agent, Mr Grieve, had no objection to the letter of representation being circulated.  The other late respondents, Mr and Mrs Boyd were not present.

 

The Committee resolved:-

(i)            that the letter of representation by Dr and Mrs King be introduced into the proceedings; and

(ii)          that the letter of representation by Mr and Mrs Boyd not be introduced into the proceedings.

 

The Committee heard from twelve of the respondents, namely: Mr McArthur, Ms Ward, Mr Kennedy, Mr and Mrs Wightman, Mr and Mrs Briggs, Ms Garvie, Mr Broadfoot, Mrs Broadfoot, Ms Reid, Mr Duncan on behalf of Rosemount and Mile-End Community Council, Mrs Kennedy and Dr and Mrs King.

 

Three of the respondents, Ms Spalding, Mr Dean and Dr and Mrs McKinlay, were not present, and were not represented.

 

The Committee then heard from the applicant’s agent Mr Grieve, Grant Property Solutions, in support of the application.

 

Councillor Townson, seconded by the Convener moved:-

that the application be granted.

 

Councillor Nicoll, seconded by Councillor Reynolds moved as an amendment:-

that the application be refused on the basis that the property was unsuitable for occupation as an HMO due to the amenities it contained, as well as the possibility of undue public nuisance.

 

On a division, there voted:- for the motion (5) – the Convener; and Councillors Copland, Hutchison, MacGregor and Townson; for the amendment (7) – Councillors Allan, Cormie, Delaney, Lawrence, Malone, Nicoll and Reynolds.

2.            RENEWAL OF A LICENCE FOR A HOUSE IN MULTIPLE OCCUPATION

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager and one letter of representation.

 

The Committee heard from the respondent, Mr Simpson.

 

The Committee then heard from the applicant Ms Kincaid and her agent, Mr Harley – Margaret Duffus Leasing, in support of the application.

 

The Committee resolved:

The Committee heard from Mr Ally Thain, Private Sector Housing Manager who advised that the applicant had asked that the application be deferred to the next meeting as he had required to leave today’s meeting prior to the item being considered.

The Committee had before it a report by Mr Ally Thain, Private Sector Housing Manager.

 

Mr Thain advised that two letters of representation had been received in respect of the application beyond the statutory time period within which such letters must be received (21-day period).  He further advised that the Committee might consider late representations if it was satisfied that it was reasonable for the respondents to make the representation after the deadline.

 

One of the late respondents, Mr Henderson was present and explained why his letter of representation was late and why it should be considered today. Mr Henderson, advised that he was also present to speak on behalf of the other late respondent, Ms Adam, who could not be present at today’s meeting. Mr Henderson explained why Ms Adam’s letter of representation was late and should be considered today.

 

The Committee resolved:-

that the letters of representation by Mr Henderson and Ms Adam be introduced into the proceedings.

The Committee had before it an information note which advised that this item was on the agenda as the applicant was seeking a variation to the terms of their public entertainment licence by applying for a terminal hour of 2am on 1 January on an annual basis.  The premises currently operated Monday to Sunday, 8am to midnight.  The application required to be determined by 31 December 2015.

 

The Committee resolved:

15.         VARIATION OF A MARKET OPERATOR LICENCE – ABERDEEN CASTLEGATE MARKET

Application Reference Number - 4/15

Location – Castlegate

 

The Committee had before it an information note which advised that this application was on the agenda as the applicant was seeking a variation of their market operator’s licence. The operator was currently licenced to trade on Fridays, Saturdays, Sundays and on public holidays.  The variation sought to (1) allow trading on the following dates: 3, 10, 17, 21, 22 and 23 December 2015 and (2) vary the operating hours on Fridays, Saturdays and Sundays to 9am to 8pm.

 

The Committee resolved:

to grant the application.

Application Reference Number - 4/18

The Committee was advised that the application had been granted under delegated powers.

 

 

19.         GRANT OF A STREET TRADER'S LICENCE – ROSEMARY MARGARET SCOTT

Application Reference Number - 4/19

Location – St Nicholas Square, next to the Royal Bank of Scotland

Operating Hours – Monday to Sunday, 9am to 8pm

 

The Committee had before it an information note which advised that this item was on the agenda because it was an application for a grant of a temporary street trader licence in the city centre and the Committee’s guidelines stated that no street trading was permitted in the city centre save where a special case could be made out by the applicant as to why the guideline should not apply.

 

The applicant, Ms Scott, was in attendance and explained why her application was a special case and therefore why the Committee’s guideline should not apply in this case.

 

 

The Committee resolved:

to grant the application.

 

 

20.         GRANT OF A STREET TRADER'S LICENCE – SARAH BEATTIE

Application Reference Number - 4/20

Location – (1) Moss Road, West Side, 160metres south of Gateway Drive, Aberdeen and (2) Gateway Drive, Northern Spur, west side, 50metres north of roundabout

 

The Committee had before it (1) an information note which advised of the position in respect of street trader licences at the Gateway Business Park; (2) a letter of representation from Total; and (3) representation from the Council’s Traffic Management Team.

 

The applicant, Ms Beattie, was in attendance.

 

The respondent, Mr Steel, on behalf of Total, was present.

 

Mrs O’Hare, Legal Advisor, advised that the applicant had now advised that the application in respect of the site at Moss Road, West Side, 160metres south of Gateway Drive, Aberdeen, had been withdrawn and therefore the application was solely for the site at Gateway Drive, Northern Spur, west side, 50metres north of roundabout.  She also explained that the letter of representation from Total had been in respect of the site which had been withdrawn.

 

The Committee heard from the respondent, Mr Steel, who advised of Total’s general concerns regarding the location of street trader (hot food) sites in the Gateway Business Park.

 

The Committee heard from the applicant, Ms Beattie, in support of the application, during which she confirmed that the application for a licence for site 1 on Gateway Drive had been withdrawn.

 

The Committee resolved:

(i)            to grant the application for a street trader’s licence on Gateway Drive Northern Spur, west side, 50metres north of roundabout (site 1 on the map) and to note that the application for a street trader’s licence on Moss Road, West Side, 160metres south of Gateway Drive, Aberdeen, had been withdrawn; and

(ii)          to request the Enforcement Officer to investigate the general comments in respect of the location of street trader sites in the Gateway Business Park.

 

 

21.         GRANT OF A WINDOW CLEANER’S LICENCE – DONALD MATHESON

Application Reference Number - 4/21

 

With reference to article 2 of the minute of the meeting of the Licensing Urgent Business Sub Committee of 30 July 2015, the Committee had before it an information note which advised that this item was on the agenda because the application had been considered and refused within the last year been as the applicant had not provided public liability insurance.

 

The note explained that in terms of paragraph 6 of Schedule 1 to the Civic Government (Scotland) Act 1982, where a licensing authority had refused an application, it should not, within one year of their refusal, entertain a subsequent application for the grant of the same kind of licence in respect of the same activity in the same area, unless in their opinion there had been a material change of circumstances.  Therefore, before the Committee could determine the application, the Committee would have to decide if, in its opinion, there had been a material change.

 

The Committee heard from Mrs O’Hare, Legal Advisor, who advised that the applicant could not be present today, however the material change proposed by the applicant was that the necessary insurance document had been provided along with the current application.

 

The Committee resolved:-

to agree that provision of the necessary insurance, along with the current application, constituted a material change of circumstances and therefore to consider the application.

 

The Committee considered the application.  The applicant was not in attendance.

 

The Committee further resolved:-

to grant the application.

 

 

22.         RENEWAL OF A PRIVATE HIRE CAR DRIVER'S LICENCE – HUBERT AMANOWICZ

Application Reference Number - 4/22

 

The Committee had before it an information note which advised that the applicant was previously granted his private hire driver’s licence without having taken the required knowledge test.  The applicant was now applying to renew his licence and to date the applicant had not taken, nor passed the knowledge test.

 

The applicant was represented present, along with Mr Wrobel, who acted as a translator for the applicant.

 

The Committee heard from Mrs O’Hare, Legal Advisor, who advised that a letter of representation had been received beyond the statutory time period within which such letters must be received (21-day period).  She further advised that the Committee might consider late representation if it was satisfied that it was reasonable for the respondent to make the representation after the deadline.

 

The Committee heard from the late respondent, Ms Evita Judina, AB Transfer Ltd, who explained why her letter of representation was late and why it should be considered today.

 

The Committee resolved:-

that the letter of representation by Ms Evita Judina, AB Transfer, be introduced into the proceedings.

The Committee heard from the applicant, Mr Amanowicz, who spoke in support of the application.

 

Councillor Townson, moved as a motion, seconded by Councillor Copland:-

that the application be granted.

 

Councillor Reynolds, moved as an amendment, seconded by the Convener:-

that the application be granted for six months with a condition that the applicant was required to pass the street knowledge test during this period.

 

Councillor Delaney, moved as a further amendment, seconded by Councillor Nicoll:-

that the application be refused.

 

There being a motion and two amendments, the Committee first divided between the amendment by Councillor Reynolds and the amendment by Councillor Delaney.

 

On a division, there voted:-  for the amendment by Councillor Reynolds (9) – the Convener; and Councillors Allan, Cormie, Graham, Hutchison, Lawrence, MacGregor, Malone and Reynolds;  for the amendment by Councillor Delaney (2) – Councillors Delaney and Townson; and declined to vote (1) – Councillor Copland.

 

The Committee then divided between the motion and the amendment by the Councillor Reynolds.

 

On a division there voted:- for the motion (3) – Councillors Copland, Hutchison and Townson; and for the amendment by Councillor Reynolds (10) – the Convener; and Councillors Allan, Cormie, Delaney, Graham, Lawrence, MacGregor, Malone, Nicoll and Reynolds.

 

 

The Committee resolved:

to adopt the amendment by Councillor Reynolds.

 

 

23.         RENEWAL OF A PRIVATE HIRE CAR DRIVER'S LICENCE – ABDELHAMID CHAFI

Application Reference Number - 4/23

 

The Committee had before it an information note which advised that this item was on the agenda as the applicant was previously granted his private hire driver’s licence without having taken the required knowledge test.  The applicant was now applying to renew his licence and to date the applicant had not taken nor passed the knowledge test.

 

The applicant, Mr Chafi, was in attendance and spoke in support of the application.

 

Councillor Reynolds, moved as a motion, seconded by Councillor Graham:-

that the application be granted for six months with a condition that the applicant was required to pass the street knowledge test during this period.

 

Councillor Townson, moved as an amendment:-

that the application be granted.

 

The amendment by Councillor Townson did not attract a seconder,
however, and therefore fell.
