The press and public were excluded from the meeting for consideration of the following items which contained confidential information in terms of Section 50A 3(b) of the Local Government (Scotland) Act 1973.

9.

Request for Exemption from Wheelchair Accessible Vehicle Policy - Taxi Vehicle Licence (Agenda Item 8.1)

Minutes:

The Committee had before it an information sheet prepared by the Chief Officer – Governance, which advised that the applicant was seeking an exemption to the current Committee Policy which stated that any new grant application for a taxi must be for a Wheelchair Accessible Vehicle.

 

A letter dated 10 May 2021 from the applicant’s Doctor and a letter dated 14 June 2021 from the Council’s Occupational Health provider had been circulated to members during the meeting.

 

The applicant was in attendance and spoke in support of his request and answered questions from members of the Committee.

 

The Committee resolved:-

to approve the request for exemption from Wheelchair Accessible Vehicle Policy.

10.

Renewal of a Taxi Driver Licence (Agenda Item 8.2)

Minutes:

The Committee had before it an information note prepared by the Chief Officer – Governance which advised that the application had to be determined by 15 September 2021.

 

The licence holder was not in attendance, nor represented.

 

The Committee resolved:-

to defer consideration of the application to allow a medical report to be received and to agree that should a clear medical report be received, the Chief Officer - Governance could grant the licence under delegated powers, or otherwise that the application be referred to a meeting of the Licensing Sub Committee for consideration.

11.

Renewal of a Taxi Driver Licence (Agenda Item 8.3)

Minutes:

The Committee had before it an information note prepared by the Chief Officer – Governance which advised that the application had to be determined by 17 October 2021.

 

The licence holder was not in attendance, nor represented.

 

The Committee resolved:-

(i)       to defer consideration of the application to allow a medical report to be received and to agree that should a clear medical report be received, the Chief Officer - Governance could grant the licence under delegated powers, or otherwise that the application be referred to a meeting of the Licensing Sub Committee for consideration; and

(ii)       to agree that should the licence holder withdraw his application and submit a new grant application at a later stage, to waive the fee and the requirement to undertake the street knowledge test for that single application.

12.

Renewal of a Taxi Vehicle Licence (Agenda Item 8.4)

Minutes:

The Committee had before it (1) an information note prepared by the Chief Officer – Governance in respect of the application which advised that the application had to be determined by 20 June 2022; and (2) a letter of representation from the Chief Superintendent, Police Scotland, c/o North East Division dated 12 July 2021.

 

The licence holder was in attendance and spoke in support of the application.

 

Sergeant Flett was in attendance and spoke in support of Police Scotland’s letter of representation.

 

Sergeant Flett and the applicant both summed up.

 

The Committee resolved:-

to grant the renewal of the Taxi Vehicle Licence.

13.

Grant of a Street Trader (Employee) Licence (Agenda Item 8.5)

Minutes:

The Committee had before it (1) an information note prepared by the Chief Officer – Governance in respect of the application which advised that the application had to be determined by 19 May 2022; and (2) a letter of representation from the Chief Superintendent, Police Scotland, c/o North East Division dated 17 June 2021.

 

The licence holder was not in attendance, nor represented.

 

Sergeant Flett was in attendance and spoke in support of Police Scotland’s letter of representation.

 

The Committee resolved:-

to refuse to grant the licence.
