Minute of Previous Meeting of 5 September 2018

Minutes:

The Sub Committee had before it the minute of its meeting of 5 September 2018.

 

The Sub Committee resolved:

to approve the minute as correct record.

Minute of the Meeting of the Appeals Committee of 26 January 2018

Minutes:

The Sub Committee had before it the minute of the meeting of the former Appeals Committee of 26 January 2018.

 

The Sub Committee resolved:

to approve the minute as correct record.

 

3.

Appeal 18/03

Minutes:

The Sub Committee had before it the papers circulated relative to the appeal against the decision of Aberdeen City Council to dismiss the Appellant identified in the Register of Appeals as appeal 18/03. The Sub Committee considered the appeal in accordance with procedure.

 

At the commencement of the hearing, two preliminary matters were raised by the Management Officer and considered by the Sub Committee.

 

The Sub Committee then heard submissions on behalf of both parties.  Three witnesses were called on behalf of Management and the Sub Committee heard from the Appellant.Members questioned the witnesses, the Management Officer and the Appellant on the evidence given.  Both parties then made a closing statement.

 

The meeting was then adjourned to allow the Sub Committee to deliberate in private.

 

The Sub Committee then considered and assessed the evidence before them following the submissions from both parties, during which they recalled both parties to seek further clarification from the Appellant on one matter.

 

Thereafter the hearing was re-convened to allow the parties to hear the Sub Committee’s decision.

 

The Sub Committee resolved:

to agree to dismiss the appeal on the grounds that it was satisfied that Management had acted fairly and reasonably in this matter and consequently that the decision to dismiss the Appellant on grounds of capability should be upheld.
